FSSAI governs the food businesses in India, which is introduced to assure the safety, hygiene and quality of food. It is issued by the food authority of India.  FSSAI is responsible for formulating science based food standards and regulating the manufacture, storage, distribution, and sale of food to ensure consumer safety. A function of FSSAI is to registered and provide license to the food business operators and most importantly to lay down the rules and regulations for the food business.

The Food Safety and Standards Authority of India FSSAI has been established under Food Safety and Standards, 2006 which consolidates various acts & orders that have hitherto handled food related issues in various Ministries and Departments. FSSAI has been created for laying down science-based standards for articles of food and to regulate their manufacture, storage, distribution, sale and import to ensure availability of safe and wholesome food for human consumption. The Head office of FSSAI is located at Delhi and other regional offices are located in Delhi, Guwahati, Mumbai, Kolkata, Cochin, and Chennai.

FSSAI has introduced an online application Food Licensing and Registration System (FLRS) to facilitate Food Business Operators (FBO) in India to apply for license and registration certificate.

FSSAI is introduced food licensing & registration system for facilitate food business operators (FBO) in India which is online application. As per law, no individual is allowed to start any food business without obtaining a license. FSSAI License or FSSAI Registration is mandatory before starting any food businesses such as manufacturers, traders, restaurants, small eateries, grocery shop, importers, exporters, home based food businesses, dairy farms, processors, retailers, e-retailers, transporter, hotel, catering, packaging, storage, distribution, and retail food sale of products in India and outside India. FSSAI license is a 14- Digit registration number or a Food license number which must be printed on food packages and displayed in office premises.

Guidelines on FSSAI License Number

  • The FSSAI logo and FSSAI license number shall be displayed on the label of the food package in contrast colour to the background.
  • In case of multiple units (manufacturer/ packer/ relabeller/ marketer) the FSSAI logo and license number of the brand owner shall be displayed on the label of the food package. The addresses of the multiple units on the label should carry the FSSAI license number.
  • In case of imported food products, the importer shall display FSSAI logo and FSSAI license number along with the name and address of importer. These may either be pre-printed on the label or affixed through a sticker before customs clearance.
  • The height of letters and numeral of license number shall be as prescribed in 2.3.3 of Food Safety and Standards (Packaging and Labelling) Regulation, 2011.
  • The permit number and logo are permitted to be shown on the name until the legitimacy of the permit according to the direction of the Food Safety and Standards (Business and enrolment on Food business) Regulations, 2011
  • The Regulation 2.6.1 of Food Safety and Standards (Packaging and Labelling) Regulations, 2011 shall be applicable to display of FSSAI License number and logo.
  • The display of FSSAI logo on the label of the food product is not a mark of certification but it signifies that the FBO holds a valid license under Food Safety and Standards Act, 2006

What are the criteria for FSSAI registration?

FSSAI registration or license is must for any individual or organisation engaged in manufacturing, sale, import, export and storage of the food and beverages. Even hawkers and street vendors are required to get FSSAI registration.

Which license is required to run a food business in more than one state?

Central License is required to run a food business in more than one state.

How to renew FSSAI license/registration after expiry?

FSSAI license renewal can be applied by filing relevant Form before the expiry of license. Renewal of license must be filed prior to 30 days of the expiry of license in order to avoid a late fee of Rs.100 per day. For example, if the license is going to expire on 31 st May 2019, then renewal can’t be done after 31st May 2019. Also, if an application is filed on or after 2nd May 2019, then the late fee of Rs. 100 per day will be levied starting form 2nd May 2019.

What is the due date for filing FSSAI return?

Due date of filing FSSAI annual return in respect of each financial year is 31 st May. For example, FSSAI annual return for the year 2018-19 is required to be furnished by 31 st May 2019. FBO dealing in manufacturing of milk and milk products are required to half-yearly return within one month from the end of relevant half-year. For example, in case of entity involved in milk and milk products FSSAI return for the period 1 st April till 30th September is required to be furnished by 30th October and FSSAI return for the period 1st October till 31st March is required to be furnished by 30th April.

Is it mandatory to file FSSAI annual return?

Yes, it is mandatory to file FSSAI annual return even in case of NIL business. But, street vendors, Fast food joints, restaurants, grocery stores, canteens, hawkers, are exempted form filing of FSSAI return.

What information are required for filing FSSAI annual return?

Apart from Name, address, license number of licensee a statement showing quantities of food products manufactured / handled / imported and exported in tonnes is required for filing FSSAI annual return.

Which form is filed for FSSAI return?

Form D is used to file FSSAI return. Specifically, Form D1 is the format to file an annual return for businesses other than dairy units and Form D2 is used by dairy units to file half yearly return.

What is consequence of not filing FSSAI return on due date?

Non-filing of FSSAI return on or before the due date will attract a late fee of Rs. 100 per day with no upper cap.

What is the validity of FSSAI license or registration?

FSSAI license or registration is valid for a period of 1 to 5 years depending upon the selection and fee paid at the time of application.
